O R D E R
This writ petition has been filed for a mandamus seeking for a direction to the third respondent to forward the increment proposal of late. Sakthivel to the first respondent through the second respondent and consequently direct the first respondent to provide the same along with the arrears and all other benefits to the petitioner within a time frame to be fixed by this Court.
2. The petitioner's grievance is that the increment proposal for her late husband Sakthivel was not implemented, despite the third respondent having forwarded the same to the first respondent through the second respondent. The petitioner's husband was working as Junior Assistant in the third respondent office. He died after he retired from service. The petitioner is the wife of the deceased Sakthivel. The petitioner claims that she is entitled for the relief as sought for in this writ petition. The petitioner has already given a representation on 06.12.2021 prior to the filing of this writ petition seeking for the relief as prayer for in this writ petition. Since the representation has not 2/5
been considered by the respondents, the petitioner has filed this writ petition. Till date, the counter-affidavit has not been filed by the respondents. However, the learned Additional Government Pleader appearing for the respondents is present.
3. No prejudice would be caused to the respondents, if the petitioner's representation as stated supra, is considered on merits and in accordance with law, within a time frame to be fixed by this Court.
4. For the foregoing reasons, this Court directs the second respondent to pass final orders on merits and in accordance with law on the petitioner's representation dated 06.12.2021 seeking for payment of arrears and all other benefits on account of the petitioner's husband late. Sakthivel, within a period of three months from the date of receipt of a copy of this order. The petitioner is directed to submit all relevant records before the second respondent to enable the second respondent to consider the petitioner's representation on merits and in accordance with law. This Court has not expressed any opinion on the merits of the petitioner's case. No costs.
