ORDER

The petitioner's daughter Parimala, who was married to one Thangaraj on 24.03.2024, died in a suspicious manner on 02.10.2024. Therefore, he lodged a complaint before the respondent Police and the same was registered in Crime No.548 of 2024 on the file of the 3rd respondent Police under Section 174 Cr.P.C. Now, the petitioner, with a grievance that the respondent Police has not conducted any investigation, has filed this petition seeking transfer of investigation.

2. The learned counsel appearing for the petitioner submits that though the petitioner's daughter died in a suspicious manner within few months from the date of marriage, there was no enquiry conducted by the concerned Revenue Divisional Officer.

3. The learned Additional Public Prosecutor submits that the contention of the petitioner is not correct. The Revenue Divisional Official has conducted an enquiry and submitted a report. Apart from that, the body 2/5

of petitioner's daughter was subjected to postmortem. The respondent Police has also received the postmortem report and viscera report. The investigation reveals that due to electrocution, the petitioner's daughter died. He further submits that the respondent Police is likely to conclude the investigation and file the final report within a period of two weeks.

4. This Court considered the rival submissions made.

5. The petitioner's daughter died on 02.10.2024, for which, a criminal case in Crime No.548 of 2024 has been registered under Section 174 Cr.P.C. The petitioner, with a grievance that the investigation has not been conducted by the respondent Police, has filed this petition seeking transfer of investigation.

6. The respondent Police claims that the investigation is being conducted in a proper manner and they would conclude the investigation within two weeks. It is always open to the respondent Police to file the final report. After filing the final report, the respondent Police is directed to furnish a copy of the final report to the petitioner enabling him to workout his remedy before the concerned Judicial Magistrate. In the event, if the closure report is filed by the respondent Police, it is open to the petitioner to 3/5

challenge the same with the available materials before the concerned Judicial Magistrate by filing a protest petition.
