Respondents PRAYER:This petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the first respondent to consider and dispose of the petitioner's representation dated 13.08.2019 sent for the purpose of removal of encroachment at a pathway situated at SVD Nagar, Sikkandharsavadi, Madurai District.

(Order of this Court was made by T.S.SIVAGNANAM, J) Heard Mr.R.Anand, learned counsel appearing for the petitioner and Mr.M.Murugan, learned Government Advocate accepts notice on behalf of the respondents.

2.By consent of either side, this writ petition is taken up for disposal.

3.The petitioner by way of this writ petition expresses the grievance with regard to the construction of a drainage channel being constructed by the Government and the drainage channel is being deviated, so as to protect, some of the encroachers, who are politically powerful people in the locality. In this regard, a representation was given to the District Collector on the grievance day and the same has been acknowledged on 19.08.2019. https://hcservices.ecourts.gov.in/hcservices/

4.The learned Additional Government Pleader on instruction submitted that since the representation is received by the District Collector he has issued a direction to the Tahsildar, Madurai North Taluk, second respondent, who has surveyed the area and further the learned Additional Government Pleader submitted that if there is any encroachment, the same will be removed and the pathway of such channel as originally designed will be adhered to and the said submission made on behalf of the respondent is placed on record and we direct the second respondent to ensure that no deviation of the original pathway of the channel and if there is any encroachment in obstructing the construction of the channel, they should be removed. 5.With the above direction, this writ petition stands disposed of. No costs.
