PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of certiorari to call for the records pertaining to the second respondent impugned order in Na.Ka.No.9665/AA4/2023, dated 15.11.2023, confirming the impugned order passed by the third respondent in O.Mu.No.4124/AA3/2023, dated 12.09.2023, and O.Mu.No.4123/AA3/2023, dated 11.09.2023, passed by the third respondent dismissing the application under Section 77-A of the Registration Act filed by the petitioner. For Petitioner :

ORDER

With consent of the parties, the Writ Petition is taken up for final disposal at the admission stage itself. Therefore, no counter is required.

2. This Writ Petition has been filed for issuance of a writ of certiorari to call for the records pertaining to the second respondent impugned order in Na.Ka.No.9665/AA4/2023, dated 15.11.2023, confirming the

impugned order passed by the third respondent in O.Mu.No.4124/AA3/2023, dated 12.09.2023, and O.Mu.No.4123/AA3/2023, dated 11.09.2023, passed by the third respondent dismissing the application under Section 77-A of the Registration Act filed by the petitioner.

3. The petitioner originally gave a complaint to the respondent authority invoking Section 77-A of the Registration Act to cancel the document executed by the fifth respondent in favour of third parties.

4. According to the petitioner, she is already having a right in the joint family property, but, however, the fifth respondent, taking advantage of the Power of Attorney, sold the property to third parties.

5. At the outset, the very grievance of the petitioner will not lie before the Sub-Registrar or District Magistrate. If at all the petitioner claims any right over the property, the proper remedy available to her is to file a partition suit before the Civil Court.

6. Therefore, I do not find any merit in this Writ Petition, which is dismissed. No costs. Consequently, the connected W.M.P.(MD) Nos. 15997,15998 and 16001 of 2024 are closed.
