For Respondent : R.Meenakshi Sundaram, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.41 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 302 of IPC in Crime No.41 of 2021, seeks anticipatory bail. 2.The case of the prosecution is that on 25.07.2021, at about 11.00 a.m., due to the family dispute, the petitioner jumped into the well for committing suicide and floated her children also. When the Fire Service came to rescue them, the two children died and the petitioner looked as very tired. Thereafter, the defacto complainant sent the petitioner for taking treatment in Government Hospital along with body of the children. Hence, the present case came to be registered.

CRL OP(MD). No.15854 of 2021 3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and she has not committed any offence as alleged by the prosecution and she has been falsely implicated in this case.

4.The learned Government Advocate (Crl.Side) appearing for the respondent police, on instructions, would submit that the investigation is pending.

5.Taking into consideration the facts and circumstances of the case and the fact that she is the only cause for the death of her children aged about five years and nine months respectively, this Court is not inclined to grant anticipatory bail to the petitioner. 6.Accordingly, this Criminal Original Petition is dismissed. sd/- 12/10/2021 / TRUE COPY / / /2021 Sub-Assistant Registrar (C.S.)
