PRAYER :- Criminal Miscellaneous Petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 to relax the condition imposed on the petitioners by this Court in Crl.OP(MD) No.5225 of 2025 dated 16.04.2025 in connection with the Crime No.1 of 2025 on the file of the respondent police. Mr.Thanga Aravindh.B, Government Advocate (Criminal Side) ORDER : The Court made the following order :- This petition has been filed to relax the condition imposed on the petitioners in Crl.OP(MD)No.5225 of 2025 dated 16.04.2025.

2. The learned counsel for the petitioners submitted that since the petitioners were affected by food poisoning, they were unable to appear before the respondent police and comply with the condition from 21.06.2025 to 27.06.2025 due to their health condition. Thereafter, from 28.06.2025 till date, the petitioners have been complying with the condition imposed by this Court regularly, and he prays for relaxation of the said condition.

3. The learned Government Advocate (Criminal Side) submitted that the 2/4

petitioners were absent from 21.06.2025 to 27.06.2025. However, from 28.06.2025 till date, the petitioners have been complying with the condition regularly.

4. Considering the nature of offence, and also considering the reasons stated in the petition, the condition imposed by this Court, in Crl.OP(MD).No.5225 of 2025 dated 16.04.2025, is modified and the petitioners shall appear and sign before the learned Judicial Magistrate No.II, Pudukottai, weekly once, i.e. on every Monday at 10.30 a.m., until further orders.

5. With the above modification, this Criminal Miscellaneous Petition is allowed.
