Respondents Prayer: Writ Petition is filed under Article 226 of Constitution of India, to issue a Writ of Certiorarified Mandamus, to call for the records relating to new batch list prepared by the 4th respondent and quash the same as illegal and arbitrary and to direct the respondents to implement Clause 32 of the Settlement, dated 06.02.2008, by giving duty posting to the Drivers and Conductors on rotational basis on seniority by including all the route buses and town buses and further direct the respondents not to allot any buses under its control to any Union, on the basis of the representation dated 09.12.2017.

ORDER

When this matter had come up for hearing on 23.11.2011, the absence of the petitioner was recorded. Incidentally, since the prayer of the petitioner was for implementation of Clause 32 of settlement arrived at in terms of Section 12(3) of the Industrial Disputes Act, 1947, a copy of the same was sought from the learned counsel for the petitioner.

2.The leaned Standing counsel appearing for the respondents has circulated a copy of the Section 12(3) settlement before this Court today.

3.Though the matter has been listed under the caption 'for dismissal', there is no appearance by or on behalf of the petitioner. Thus, this Writ Petition is dismissed for nonprosecution. No costs. Consequently, connected miscellaneous petition is closed.
