PRAYER :- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 to 4 to take appropriate action on the petitioner's representations dated 26.08.2025, 08.01.2026 and 13.04.2026 regarding the smoke pollution and environmental nuisance caused by the fifth respondent's hotel, conduct an inspection and ensure compliance with the applicable pollution control norms, and in the event the pollution cannot be effectively abated, take appropriate action in accordance with law, including closure or relocation of the polluting activity.

The prayer in this writ petition is to issue a Writ of Mandamus, directing the respondents 1 to 4 to take appropriate action on the petitioner's representations dated 26.08.2025, 08.01.2026 and 13.04.2026 regarding the smoke pollution and environmental nuisance caused by the 5th respondent's Hotel, conduct an inspection and ensure compliance with the applicable pollution control norms, and in the event the pollution cannot be effectively abated, take appropriate action in accordance with law, including closure or relocation of the polluting activity.

2. Without expressing any opinion on the merits of the case, the respondents are directed to consider the representations submitted by the petitioner dated dated 26.08.2025, 08.01.2026 and 13.04.2026 and pass appropriate orders in accordance with law, after giving opportunity of hearing to the petitioner and the 5th respondent. If the authorities find from the enquiry / inspection that the 5th respondent's Hotel is causing smoke pollution and environmental nuisance as alleged by the petitioner, then the authorities shall take action as per law. The said exercise shall be completed within a period of three months from the date of receipt of a copy of this order.
