ORDER

The petitioner, who is the defacto complainant in Cr.No.142 of 2025 on the file of the third respondent Police, has filed this petition seeking a direction to the respondent Police to complete the investigation in the said case.

2.The case in Cr.No.142 of 2025 has been registered at the instance of the petitioner on 24.06.2025. The petitioner has submitted his representation dated 30.06.2025 to complete the investigation and filed this petition.

3.The case in Cr.No.142 of 2025 has been registered for the offence under Sections 191(2), 296(b), 115(2), 118(1), 351(3) BNS. The statute itself prescribe a time limit for filing the final report for the offences of this nature. However, within six days from the date of registration of the case, the petitioner has submitted a representation to complete the investigation and file the final report, within a period of one month. The petitioner has also filed this petition running 13 pages to substantiate his prayer. However, this petition has been filed without even verifying the provisions of BNS. When this Court has pointed out to the learned counsel appearing for the petitioner, he has realized the mistake and seeks permission of this Court to withdraw this petition. 4.Filing of petition before this Court is not a fun. For responding this petition, the Government has spent not less than a sum of Rs. 3/6

10,000/- and the Police Officer attached to the respondent Police is appearing before this Court to instruct the learned Government Advocate as to the stage of the investigation. The Government is also paying Rs. 4,500/- to the learned Government Advocate for disposal of the case. 5.Considering the manner in which this petition has been filed and in order to avoid filing of such petition in future, this criminal original petition is dismissed with a cost of Rs.5,000/- payable by the petitioner to the respondent Police Station.
