O RDER This Criminal Original Petition is filed seeking for a direction to transfer the investigation being done by the second respondent based on the representation of the petitioner dated 13.062023 to any other Police Station.
2. It is submitted by the learned counsel appearing for the petitioner that the petitioner was given with a patta by the Government on 11.06.2016 in respect of plot No.59 in Survey Nos.61/2 and 61/6. However, the third respondent without any right illegally has put up a shop in the said plot. The petitioner stated to have given a complaint to the respondents Police. However, no action has been taken.
3. The learned Government Advocate appearing for the official respondents, on instructions, submits that his representation which has been received from the Superintendent of Police was numbered and the enquiry was initiated. The petitioner was asked to appear on 19.07.2023 by way of issuing a summon on 16.07.2023. However, the petitioner instead of appearing before the respondents Police has submitted a representation and approached this Court with false complaint. 2/4
4. Considering the circumstances, the petitioner is directed to appear before the respondents Police on 31.07.2023 at 11.00 a.m., in respect of the said complaint and the respondents Police are directed to dispose of the representation of the petitioner within a period of two weeks thereafter.
5. With these directions, this Criminal Original Petition is disposed of.
