ORDER

The writ petition is filed seeking a direction to the 1st respondent to call for the report from the 2nd respondent as per the proceedings dated 28.12.2021 in Na.Ka.No.4008/2021/B4, regarding the claim of the petitioner, seeking restoration of patta in respect of the land situated in Survey No.67/1B, Uthangudi Vllage, Madurai East Taluk, Madurai District by considering the petitioner's representation dated 11.08.2021.

According to the petitioner, he submitted a representation on 11.08.2021, seeking cancellation of patta issued in the name of the third parties and restoration of joint patta in the name of the petitioner. Based on the said application, the 1st respondent in his proceedings dated 28.12.2021 directed the 2nd respondent to conduct investigation and file a report. However, the same has not been considered. Hence, the petitioner has come before this Court with the above mentioned prayer. 2/4

3. The learned Government Advocate appearing for the respondents 1 and 2 would submit that the representation submitted by the petitioner dated 11.08.2021 will be considered in accordance with law.

In view of the same, without expressing any opinion on the merits of the matter, the 2nd respondent is directed to submit his report before the 1st respondent within a period of four (4) weeks from the date of receipt of a copy of this order. The 1st respondent shall consider the representation of the petitioner dated 11.08.2021 and pass final orders on its own merits and in accordance with law within a further period of twelve (12) weeks therefrom, after issuing notice to the petitioner, persons in whose name patta stands as on today and other interested parties.

5. The writ petition is disposed of with the above observations. No costs.
