ORDER : The Court made the following order:- The petitioner, who is arrayed as A4 was arrested, on 03/06/2022 and remanded to judicial custody for the alleged offences punishable under sections 294(b), 353, 379, 332, 307, 399 IPC and 25(1A) of Arms Act, 1959, in Crime No.439 of 2017 on the file of the respondent, seeks bail.
2.The case of the prosecution is that the Inspector of Police attached to Thogamalai Police Station along with team of members were on routine vehicle check up and they received an information that on 18/07/2017, some people have gathered for the purpose of committing robbery and they are on the way from Thogamalai to Karur. So along with the police men, he conducted vehicle check up. At that time, 3 two wheelers were intercepted and on suspicion, they were about to search. At that time, the accused Suntharrajan immediately took a pistol and tried to make a threat, he was apprehended and the other accused persons escaped. There were chased for. Later, they were also apprehended. They tried to assault the police team and in fact assaulted the police team, in which, one of the police members were injured. On
enquiry, they have stated that they belong to rowdy group and are proceeding to the spot for the purpose of committing robbery. They also revealed that on 18/08/2017, along with other accused persons namely Jega @ Jegadeesan, Gowtham, Vattu Senthil, Suntharrajan made preparation for committing robbery. So before committing, they were apprehended and arrested. On that basis, they were taken to custody and from them, a pistol and other incriminating articles have been recovered and the petitioner was at large and later, he was arrested and in Crime No.553 of 202 on the file of the Urailyur Police station and he was in custody and PT warrant was issued and formally, he was arrested and ever-since, he is in custody.
3.Seeking bail, this petition has been filed on the ground that he was not available in the place of occurrence. Based upon the statement of the co-accused, his involvement has been alleged and now final report has been filed before the concerned court and the co-accused are either released on bail or released on anticipatory bail. The detention order was also revoked by the Government. So on that ground, this petition has been filed.
4.It is seen that the petitioner is involved in several cases mostly of which robbery, murder, decoity. 5.But however, considering the fact that now final report has been filed before the concerned court and the similarly placed persons have been granted bail or anticipatory bail as the case may be, this petitioner is also enlarged on bail with certain conditions. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.1, Kulithalai and on further condition that the petitioner shall report before the respondent police 10.30 am until further orders.
