Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondent to reclassify the land in occupation as residential places on the east of Kanmoi S.F.No.11/1, situated at Kannakkur Village, Avudaiyarkovil Taluk, Pudukkottai District as Government Poramboke instead of Kanmoi and then to grant natham patta by considering the Petitioner's representation, dated 3.3.2025.

The Petitioner herein seeks a direction to the respondents to reclassify the land in his occupation in S.F.No.11/1, situated at Kannakkur Village, Avudaiyarkovil Taluk, Pudukkottai District as residential land instead of water body by considering his representation, dated 3.3.2025.
2.Mrs.S.Jeya priya, learned Government Advocate takes notice for the respondents 1 to 5. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.

3.When the Writ Petition is taken up for hearing today, Mrs.S.Jeya Priya, the learned Government Advocate appearing for the respondents 1 to 5 would submit that in respect of the very same property, one S.Jeyaraman filed a Writ Petition before this Court in W.P(MD)No.4911 of 2023 seeking removal of encroachment made by Petitioner in the water body. The Petitioner herein was arrayed as 9th respondent in the abovementioned Writ Petition. The Division Bench of this Court after hearing the Petitioner herein, directed the official respondents therein to take appropriate steps to remove the encroachment in the water body. When the respondents are taking steps to remove the encroachment as directed by the Division Bench, the Petitioner has come to this Court by filing the present Writ Petition just to prevent the respondents from implementing the order passed by the Division Bench.
4.Since the order was passed by the Division Bench of this Court in W.P(MD)No.4911 of 2023 for removal of encroachment made by the Petitioner, this Court is not inclined to entertain the present Writ Petition.
5.Accordingly, the Writ Petition stands dismissed. If the 3/6
Petitioner has got any grievance, the Petitioner has to approach the very same Division Bench seeking necessary directions, in the manner known to law. No costs.
