PETITION FOR MODIFICATION Under Sec.528 of BNSS PRAYER :- To modify the condition No.7(c) imposed in Crl.OP(MD).No.9097 of 2025 dated 19.06.2025.

ORDER : The Court Made the following order :- This petition has been filed to modify the condition No.7(c) imposed in Crl.OP (MD).No.9097 of 2025 dated 19.06.2025.

2. The learned counsel for the petitioners would submit that the petitioners have filed an anticipatory bail petition before this Court on 26.05.2025 in Crl.OP. (MD).No.9097 of 2025. The said anticipatory bail petition was heard and on 19.06.2025, this Hon'ble Court was pleased to grant anticipatory bail to the petitioners with certain conditions. In the said anticipatory bail order, Para.7(c) as follows: ''(c). The petitioners shall report before the respondent police daily at 10.30a.m. until further orders.''

3. He further submits that the petitioners Nos.1 and 2 are residing in Madurai 2/5

District with their families. Therefore, all the petitioners have to travel nearly 157 Kilometres every day to sign before the respondent police station. The petitioners are the only bread winners of their family. The petitioners are ready to appear before the Othakadai Police Station, Madurai. Considering the pathetic situation of the petitioners, the petitioners seek indulgence of this court by modifying the said condition imposed against them. Hence, he prays to allow this present modification petition.

4. The learned Government Advocate (Crl.side) appearing for the respondent would submit that the petitioners are not complied the said conditions even for single day. However, he has not raised any objection to allow this Criminal Miscellaneous Petition.

Considering the submissions made by the learned Counsel for the Petitioner and being satisfied with the reasons stated above, this Court is inclined to modify the Condition No.7(c) in the order made in Crl.O.P(MD).No.9097 of 2025 dated 19.06.2025. Accordingly, Condition No.7(c) is modified as ''(c). The petitioners shall appear and sign before the Inspector of Police, Othakadai Police Station, Madurai District. daily at 10.30a.m. until further orders.''. The other conditions shall remain unaltered.
