ORDER

The petitioner, with a grievance that the second respondent police is harassing and insisting him to withdraw the complaint lodged by him in Crime No.126 of 2025, has approached this Court. 2.The petitioner claims that one Nishanth has abused the petitioner in filthy language and also assaulted him, for which, he has lodged a complaint before the second respondent police on 27.06.2025. But, the second respondent Police has registered his complaint after three days on 30.06.2025 in Crime No.126 of 2025, for the offences under Sections 191(2), 296(6) and 115(2) of BNS, 2023. Since the Accused, namely, Nishanth, has exerted some pressure on the second respondent police, the second respondent police is harassing the petitioner to withdraw the complaint in Crime No.126 of 2025.

3.Mr.P.Kottaichamy, learned Government Advocate (Crl.side) takes notice for the respondents and submits that it is a case in counter. The said Nishanth has also lodged a complaint as against the petitioner on 30.06.2025 and the same has been registered in Crime No.127 of 2025 for the offences under Sections 296(b) and 115(2) of BNS, 2023. 4.This Court considered the rival submissions made. 5.The petitioner is a victim in Crime No.126 of 2025. The petitioner's grievance is that the second respondent police is harassing him to withdraw the complaint lodged by him in Crime No.126 of 2025. On the other hand, it is submitted by the learned Government Advocate (Crl. Side) that a counter complaint has been lodged as against the petitioner and the same has been registered in Crime No.127 of 2025. 6.

Since a criminal case has been registered as against the petitioner in Crime No.127 of 2025, the petitioner has to work out his remedy in the manner known to law. Since it is a case and counter, the respondent Police shall comply the clause-566 of the Police Standing Order and conduct fair investigation.

7.With the above observations, this Criminal Original Petition is closed.
