PRAYER :- For Bail in Crime No.337 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/A2, who was voluntarily surrendered on 31.08.2021 for the alleged offence punishable under Sections 147, 148, 109 & 302 of I.P.C, in Crime No.337 of 2021 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the villagers of the deceased and the petitioner are having gangster motive, due to that, some unknown persons murdered the deceased. Hence, the complaint. 1/3

3.The learned counsel for the petitioner would submit that there is no specific overt act as against the petitioner. He did not cause any injury to the deceased. He has been falsely implicated in this case with an ulterior motive. Since he is the friend of the first accused, he has been arrayed as second accused. He would further submit that the petitioner is inside the prison for the past 45 days and hence, he seeks for grant of bail. 4.The learned Additional Public Prosecutor appearing for the respondent would submit that the investigation is yet to be completed. He would further submit that apart from this case, the petitioner has involved in the following three cases. Sl.N o.

Police Station Cases 1.

Koodankulam Police Station Crime No.252 of 2020 for the offence under Sections 147, 148, 294(b), 323, 324, 427, 448, 506(2) @ 147, 148, 294(b), 323, 324, 326, 427, 448, 506(2) I.P.C.

2.

-doCrime No. 392 of 2017 for the offence under Section 107 Cr.P.C.

3.

-doCrime No.112 of 2016 for the offence under Sections 294(b), 323 I.P.C 4.Considering the antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
