ORDER

The petitioner / workman has filed this contempt petition that the respondent Management has not complied with the order of this Court in WP(MD)No.19818 of 2016, dated 27.09.2023, whereby and whereunder the petitioner was directed to be reinstated with continuity of service and all attendant benefits, however, without backwages. 2.When this petition came up for hearing, learned Counsel appearing for the respondent Management submitted that as against the order passed in WP(MD)No.19818 of 2016, dated 27.09.2023, they have filed a writ appeal in WA(MD)No.2384 of 2024 and the same is pending before a Division Bench of this Court.

3.Learned Counsel for the petitioner submitted that there is no interim order of stay in the writ appeal filed by the Management and therefore, the Management is liable to implement the order of the Writ Court in WP(MD)No.19818 of 2016.

4.This Court is not inclined to accept this contention of the petitioner, inasmuch as the Division Bench has entertained the writ appeal and also ordered notice to the petitioner. Since the Division Bench has taken cognizance of the appeal, this Court is not inclined to proceed further with this contempt petition.

5.Accordingly, this contempt petition is dismissed for the present. The parties shall work out their remedy subject to the outcome of the writ appeal.
