ORDER : The Court made the following order :- The petitioner/Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b), 323, 324, 506(ii) IPC, in Crime No.245 of 2022 on the file of the respondent police, seeks anticipatory bail. 2.The first accused and second accused are husband and wife and the wife of the defacto complainant is the sister of first accused. The case of the prosecution is that due to the marriage of the defacto complainant, there was some issue between the first accused and him, over which, on 21.08.2022 at about 01.00PM, when the defacto complainant and his wife went to their family deity temple, the accused persons assaulted the defacto complainant with iron ladle and also criminally intimidated him. Hence, the complaint. 3.The learned counsel for the petitioner submitted that the petitioner is an innocent and not committed any offence as alleged by the prosecution. However, to show her bonafide, she filed an undertaking affidavit that she will not involve in any offence in future.

CRL OP(MD). No.15301 of 2022 4.Considering the facts of the petition and the affidavit filed by the petitioner, this Court is inclined to grant anticipatory bail to the petitioner.
5.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on her appearance, before the learned Judicial Magistrate, Athoor, on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and the petitioner shall appear before the respondent police daily at 10.30 a.m. until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously. Further the petitioner is directed to file an undertaking affidavit before the trial Court that she will not involve in any offence in future.
6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
