ORDER : The Court made the following order :- The petitioners/accused, who were arrested on 29.08.2021 for the offence under Sections 143, 294(b) and 323 of I.P.C @ Sections 294(b), 323, 307 and 506(ii) of I.P.C @ Sections 294(b), 323, 506 (ii), 307 and 302 of I.P.C, in Crime No.962 of 2021 on the file of the respondent police, seek bail.

CRL OP(MD). No.15846 of 2021 2.The case of the prosecution is that on 22.08.2021 there was a scuffling taken place between two groups where the petitioners and other accused persons repeatedly attacked the deceased and caused to his death. Hence, the complaint.

3.The learned counsel appearing for the petitioners would submit that the petitioners are innocents, they have not committed any offence as alleged by the prosecution and they are in custody from 29.08.2021. Hence, he seeks for grant of bail. 4.The learned Additional Public Prosecutor would submit that the petitioners are North Indian Labourers and if they released on bail, they would abscond and they are not having any permanent address in Tamil Nadu. He would further submit that the investigation is yet to be completed. Hence, he prays to dismiss the petition.

5.Considering the gravity of offence committed by the petitioners and also the investigation is in nascent stage, this Court is not inclined to grant bail to the petitioners.
