O R D E R
The present contempt petition has been filed alleging non-compliance of the order of this Court 05.11.2024 in W.P.(MD).No. 7937 of 2023, wherein this Court has directed the respondent to pay the terminal benefits in five equal installments starting from 1st June 2025.
2. According to the learned counsel for the contempt petitioner, the society is a dormant one and due to paucity of funds, they found difficult in complying with the order of this Court. An affidavit has been filed on 28.01.2026 to the effect that they will make payment in 18 installments. To that effect, paragraph No.8 of the affidavit is extracted as follows: "8. I respectfully submit that, the said society had already paid a surn of Rs.5,30,000/- to the Petitioner on 19-01-2026 through transfer the said amount to his bank account. Further we preferred to settle or disburse the said remaining arrear amount of Rs.8,39,503/-. March 2026 onwards with the mode of payment such a way that Rs.7,92,000 with 18 equal installment and the remaining amount Rs.47,503 will be settled in a single installment in favour of the Petitioner. Further due the financial constraint of the co-operative society, our management has decided to settle the arrear amount of the petitioner herein." Page No. 2 of 4
3. The respondent is directed to pay at the rate of Rs.44,000/- p.m from March, 2026 onwards. The last installment shall carry a sum of Rs.47,503/-. In case any default in payment, the petitioner is at liberty to revive the contempt proceedings.
