ORDER

This Writ Petition has been filed seeking for issuance of a Writ of Mandamus, to direct the respondents 1 and 2 to issue the Inter-caste Marriage Certificate to the petitioner based on his application dated 09.09.2021 pending on the file of the second respondent, within a time frame to be fixed by this Court.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the respondents 1 & 2.

3.According to the petitioner, he is seeking a direction to the second respondent to consider his application dated 09.09.2021, which was given by him seeking to issue Inter-caste Marriage Certificate for getting admission for his son in the 4th respondent institute under special quota.

4.The learned Government Advocate appearing for the respondents 1 & 2 would submit that there is inordinate delay on the side of the petitiner in approaching the authority to get such certificate stating that as per the contention of the petitioner his marriage was performed in the year 2000, and all these years he has not taken any steps for getting such Inter-caste Marriage Certificate.

5. On a perusal of the records, it is revealed that after his marriage from the year 2000, the petitioner has not approached the authority to get Inter-caste Marriage Certificate. Now, since for purpose of getting admission of his son in the 4th respondent institute, the Inter-caste Marriage certificate is required, he approached the authority. As per the contention of the petitioner, the interview for admission of his son as per call letter from the 4th respondent institution is scheduled to be held on 25.10.2021. Therefore, this Court without expressing any opinion on merits, directs the respondents 1 & 2 to consider his application dated 09.09.2021 on merits and in accordance with law and pass orders on or before 22.10.2021. This Court has not given any positive direction in favour of the petitioner.

6.With the above directions, the Writ Petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
