For Petitioner : Mr.S.M.Arun Kumar For R1 : Mr.B.Thanga Aravindh Government Advocate (Crl.Side) O RDER This Criminal Original Petition is filed seeking for a direction to the first respondent Police not to harass the petitioner under the guise of enquiry in respect of a complaint given by the second respondent. 1/4

It is submitted by the learned counsel appearing for the petitioner that the petitioner was working as employee with the respondent No.2 in Tiles business and when the petitioner has decided not to work with the respondent No.2, the respondent No.2 asked the petitioner to collect about a sum of Rs.59,00,000/- from the customers and the petitioner until he worked has made efforts. However, the respondent No.2 wanted the petitioner to give guarantee for the money to be paid from the customers. It is submitted that basing on a complaint allegedly given by the respondent No.2, the Police have been harassing the petitioner and even though he has appeared during the course of enquiry, the petitioner was being asked to appear before the respondent Police repeatedly.

The learned Government Advocate (criminal side) appearing for the official respondent submits that on a complaint given by the second respondent, the petitioner was asked to appear for enquiry and he appeared before the concerned Police on 16.05.2023 and has given an undertaking that he would appear again on 08.06.2023 with all papers and explanation, however, failed to appear before the first respondent Police, thereby, enquiry in respect of the complaint given by the second respondent is still pending.

Considering the circumstances, since the respondent Police have taken steps by issuing summons to the petitioner and directed him to appear for enquiry in respect of the complaint given by the second respondent, the petitioner is hereby directed to appear for enquiry which is pending before the first respondent Police on 07.08.2023 along with explanation and whatever papers required to be submitted, on which, the first respondent Police is directed to complete the enquiry by following due process of law.
