ORDER : The Court made the following order :- The petitioner / Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 379 of IPC in Crime No. 50 of 2022, seek anticipatory bail.

2.The case of the prosecution is that on 24.03.2022, one Rajesh who is the defacto complainant found his bike missing, parked in front of his friend's house. 1/4

3. The learned counsel for the petitioner submitted that the petitioner is innocent, he has not committed any offence as alleged by the prosecution. He has been falsely implicated in this case. He further submitted that even as far as the FIR, no allegation has been made against the petitioner and seek for the relief of anticipatory bail.

4. The learned Government Advocate (Crl.side) would submit that this is the second application seeking anticipatory bail before this Court. The earlier application of the petitioner was dismissed on the ground that the petitioner is having three previous cases in the similar nature.

5. Reading of the FIR shows that a complaint has been given by the defacto complainant stating that he parked his two wheeler on 24.03.2023 at about 11 p.m., in his friend's house. The next day the two wheeler went missing.

6. Considering the bad antecedent that he is having previous cases in similar nature and there is no change in circumstances, this Criminal Original petition stands dismissed.
