ORDER : The Court made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under sections 379 I.P.C., r/w. 21(1) of Mines and Minerals (Development and Regulation) Act, in Crime No. 419 of 2021 on the file of the respondent police, seek/s anticipatory bail.

2. The case of the prosecution is that the petitioner and the other accused had transported 3 units of river sand by using a vehicle. Hence, the present case has been registered against the petitioner.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution and his name has been falsely implicated in this case.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner is having two previous cases in Crime Nos. 131 and 143 of 2021 for the offence under Sections 269, 270 IPC and that the investigation is pending.

5. Considering the facts and circumstance of the case and also considering the fact that the petitioner is having two previous cases, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, the Criminal Original Petition is dismissed.
