PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying to call for the entire records connected with the case in S.C. No.110 of 2022 pending of the file of the I Additional Sub Judge/Assistant Sessions Court, Madurai and quash the same as illegal as against the Petitioner concerned.

This Criminal Original Petition had been filed to quash the S.C. No. 110 of 2022 pending of the file of the I Additional Sub Judge/Assistant Sessions Court, Madurai.

2. When the matter is taken up for hearing, the learned Additional Public Prosecutor would submit that the Petitioner had earlier filed a petition when the final report was in PRC No.56 of 2021 on the file of the learned Judicial Magistrate No.V, Madurai. At that time, the then learned Single Judge of this Court had passed a detailed order in Crl.O.P(MD) No. 8438 of 2021 and dismissed the same on 14.10.2021. As per the submission of the learned Additional Public Prosecutor this is the second petition.

3. In view of the submission made by the learned Additional Public Prosecutor this Criminal Original Petition stands dismissed. The Petitioner is also directed to cooperate with the pending trial in S.C. No.112 of 2022 2/4
