PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.207 of 2021 on the file of the respondent Police.

ORDER : The Court made the following order :- Apprehending arrest at the hands of the respondent police for the alleged offences punishable under Sections 6(a) and 24(1) of Cigarette and other Tobacco Products Acts, 2003 and Section 77 of the Juvenile Justice (Care and Protection of Children) Act, 2015 in Crime No.207 of 2021 on the file of the respondent police, the petitioner has come forward with this petition seeking anticipatory bail.

2.The case of the prosecution is that the on 09.10.2021, the accused have sold tobacco products to the children below 18 years. Hence, the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in the present case.

4.The learned Additional Public Prosecutor opposed this petition on the ground that the petitioner is having two previous cases and that the petitioner is a main supplier in that area. https://hcservices.ecourts.gov.in/hcservices/ 1/2

5. Considering that fact that the petitioner has two previous cases pending against him and that he is the main supplier in that area, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
