PRAYER :- For Bail in Crime No.1047 of 2021 on the file of the respondent police.
ORDER : The Court made the following order :- The petitioner/A1, who was arrested on 24.09.2021, for the offence punishable under Section 25(1)(a) of Arms Act, 1959 in Crime No.1047 of 2021 on the file of the respondent Police, seeks bail. 2.The case of the prosecution is that on 24.09.2021, the Sub Inspector of Police, who is the defacto complainant, received secret information that the petitioner and other accused said to have armed with deadly weapons with an intention to threat the public. 3.The learned counsel for the petitioner submits that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution. The petitioner is in judicial custody from 24.09.2021 and hence, he seeks for grant of bail. https://hcservices.ecourts.gov.in/hcservices/
4.The learned Additional Public Prosecutor would submit that totally there are two accused in this case and the petitioner herein is arrayed as A1. The accused persons said to have stood in the middle of the road possessing with long sword and causing intimidation to the public. He would further submit that the investigation is going on and the petitioner is having 11 previous cases to his credit and he is also a history sheeted in H.S.No.677 of 2013.
5.Considering the gravity of the offence and also considering the fact that the petitioner herein is having 11 previous cases, he is also a history sheeted and he was arrested only on 24.09.2021, this Court is not inclined to grant bail to the petitioner.
