PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records of the 2nd respondent in Na.Ka.A5/6533/2023, dated 24.06.2025 and quash the same and consequently, the 2nd respondent not to evict the residence situated near S.No.239 in Kalimanagundu on the basis of the petitioner's representation dated 04.07.2025. ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) The memo issued by the 2nd respondent dated 24.06.2025 is under challenge in this Writ Petition.

2.The memo speaks about the survey of the Government lands and therefore, the said memo would not provide a cause for institution of Writ proceedings.

3.The learned Additional Government Pleader appearing for the respondents would submit that survey has been completed and encroachments are identified and notice under Section 7 of the Tamil Nadu Land Encroachment Act, 1905 (hereinafter referred to as 'the Act') was issued to the encroachers on 03.01.2025 and after affording opportunity to the encroachers, final order under Section 6 of the Act has been issued on 09.05.2025. 2/4

4.In view of the above submission, the present Writ Petition is not entertainable. Accordingly, this Writ Petition is dismissed. No costs.
