ORDER

This petition has been filed seeking to quash the C.C.No.161 of 2022 on the file of the Judicial Magistrate Additional Mahila Court, Madurai. 1/4

2. It is matrimonial dispute between the husband/petitioner and wife/second respondent. After some time from their marriage, misunderstanding arose between the petitioner and the second respondent and thereafter, they separated by obtaining divorce mutually. The second respondent filed the present compliant with regard to the threatening made by the petitioner.

3.The contention of the petitioner is that based on the complaint lodged by the second respondent, the first respondent registered First Information Report in Crime No.25 of 2020 for the offences punishable under Sections 498(A), 294(b), 506(i) IPC and Section 4 of the Tamilnadu Prohibition of Harassment of Women Act, 2002. 4.The further contention of the petitioner is that he wants to compromise the issue between him and the second respondent amicably. A joint memo of compromise was filed, which has been duly signed by the petitioner and the second respondent and also by their respective counsels. 5.The petitioner and the second respondent appeared in person along with their respective counsels and also produced their Aadhar cards before 2/4

this Court. They were also identified by the learned Additional Public Prosecutor and the Special Sub Inspector of Police, All Women Police Station, Thilagar Thidal, Madurai. Both the parties were enquired by me and they accepted the terms of compromise. Hence the Compromise Memo is recorded.

Considering the totality of the circumstances, the nature of the allegations levelled against the petitioner and also in view of the joint compromise memo, dated 30.09.2022, this Court is of the opinion that no useful purpose would be served by keeping the matter pending. 7.In the result, the Criminal Original Petition stands allowed and the entire proceedings in C.C.No.161 of 2022 on the file of the Judicial Magistrate Additional Mahila Court, Madurai, is hereby quashed in respect of the petitioner/sole accused and the terms of joint compromise memo shall form part of this order.
