PRAYER :- For Bail in Crime No.16 of 2021 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner/sole accused, who were arrested on 27.09.2021 for the alleged offence under Sections 294(b), 376(i), 506(i) and 417 of IPC, in Crime No.16 of 2021 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner on false promise of marrying the victim had sexual intercourse with her several times and thereafter refused to marry her. Hence the complaint.

3.The learned counsel for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is no way connected with the child and also submitted that if the DNA test shows that the petitioner is the father of the child, he is ready to 1/3

marry the victim girl. He would further submit that the petitioner is in judicial custody from 27.09.2021.

4.The learned Additional Public Prosecutor submitted that the petitioner is aged about 25 years had physical relationship with the victim girl, aged about 20 years by giving a false promise that he would marry her and the the victim girl gave birth to a child on 19.07.2021. Now, the petitioner refused to marry her. He further submitted that the investigation has been completed and the final report has also been filed before the concerned Court and the same was taken on file in P.R.C.No.14 of 2021.

5.Considering facts and circumstances of this case, the period of incarceration and the undertaking given by the petitioner, this Court is inclined to grant bail to the petitioner with certain conditions.

6.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Keeranoor, and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders.
