Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records relating to the respondent online status rejecting the petitioners application for grant of REV 114 legal heirs certificate made in TN720250204344 dated 04.02.2025 and quash the same as illegal and consequently directing the Tahsildar, Nanguneri, Tirunelveli district, the respondent herein to issue the Legal heirs certificate in favour of the petitioner and others for the deceased Velmurugan Nadar with in a stipulated time that may be fixed by this Court.

ORDER

This Writ Petition is disposed of at the time of admission after hearing the learned counsel for the petitioner and the learned Special Government Pleader appearing on behalf of the respondent.

This Writ Petition has been filed by the petitioner challenging the impugned communication of the respondent/Tahsildar, dated 04.02.2025, whereby, the application filed by the petitioner for issuance of the legal heir certificate has been rejected stating that "as per the report from RI and HQDT the deceased person (petitioner's father) resides in Mumbai for many years and legal heir details are not known, hence rejected."

The learned counsel for the petitioner would submit that the petitioner's father was employed in Mumbai and his permanent residence is No.5/146, Middle Street, Pillai Kulam, Unnankulam, Nanguneri Taluk, Tirunelveli District. Further, the petitioner's family members have properties only in Tirunelveli District.

It is noticed that the Government has issued guidelines in G.O.(Ms.) No.110 of 2024 dated 13.04.2024 by the Revenue and Disaster Management, Revenue Administration Wing, RA-3(2) Section, regarding issuance of the legal heir certificate, whereby certain procedures have been prescribed pursuant to the order of the Principal Bench of this Court, dated 17.06.2022 dated 12.08.2022 in W.P.No.25247 of 2021 and batch cases and W.P.No.25247 of 2021 and batch cases dated 04.01.2023,

5. Considering the above, there shall be a direction to the respondent to redo the exercise after hearing the petitioner as expeditiously as possible preferably within a period of six weeks from the date of receipt of copy of this order.

6. With the above direction, this Writ Petition is disposed of. Consequently, connected Miscellaneous Petition is closed. No costs. 14.07.2025 NCC : Yes / No Index : Yes / No Internet : Yes / No Indu 3/4
