Mr.B.Nambiselvan, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.114 of 2023 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioner/accused, who apprehends arrest at the hands of the respondent Police for the offences punishable under Sections 420, 465, 466, 468, 471 and 473 of IPC in Crime No.114 of 2023 on the file of the respondent Police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner has created forged document by using forged Government rubber stamps and stamp papers. Hence, the case. 3.The learned counsel for the petitioner would submit that the petitioner is an innocent and is falsely implicated in this case. The petitioner has been secured and remanded before the judicial custody on 04.03.2023, subsequently released on 24.03.2023 in Cr.M.P.No.950 of 2023. Thereafter, the prosecution has moved the Cr.M.P.No.1091 of 2023, seeking cancellation of bail, the same was allowed on 12.04.2023, on the ground of bad antecedent of the petitioner is not considered, while granting the bail and subsequently warrant was also issued by the order dated 12.04.2023.

4. Now the grievance of the petitioner is that he challenged the above said order by way of filing Crl.O.P before this Court, but that was not entertained. Later, he has filed Crl.R.C. No.502 of 2023 before this Court, that was also dismissed by granting liberty to approach the concerned Court for appropriate remedy.

5. Without exhausting the above said remedy, this anticipatory bail petition has been filed by this petitioner.

6. In view of the above said issue, the anticipatory bail will not lie, since the petitioner is already granted liberty to workout his remedy in the manner known to law.
