ORDER
The petitioner has filed this petition seeking a direction to the respondents to delete his name from the History Sheet in H.S.No.540 of 2016, dated 15.02.2016.
2.The learned counsel appearing for the petitioner submits that four cases have been registered as against the petitioner and he has not been convicted in any of the cases. The case in Cr.No.230 of 2015 has been closed as mistake of fact, the case in Cr.No.18 of 2016 has been ended in acquittal, the case is Cr.No.166 of 2011 has been disposed of and the final report filed in Cr.No.148 of 2015 has not been taken on file. While so, the respondent Police are maintaining the history sheet as against the petitioner. 2/5
3.The learned Additional Public Prosecutor appearing for the respondents submits that the petitioner involved in four cases and therefore, they have opened history sheet as against him. 4.This Court has considered the submissions made on either side and perused the available records.
5.If any history sheet is opened, it has to be reviewed by the concerned Officials once in two years. It appears that history sheet in H.S.No.540 of 2016 has been opened as against the petitioner in the year 2016. Even according to the respondents, the case in Cr.No.230 of 2015 has been closed as mistake of fact, the case in Cr.No.18 of 2016 has been ended in acquittal, the case is Cr.No.166 of 2011 has been disposed of and the final report filed in Cr.No.148 of 2015 has not been taken on file. This Court is unable to understand that for the case registered in the year 2015, final report has not been taken on file, so far. 6.Considering the fact that the petitioner is not having any other case, except the above said cases, this Court is inclined to allow this petition. 3/5
Accordingly, the history sheet in H.S.No.540 of 2016 dated 15.02.2016 is hereby quashed and this writ petition is allowed. No costs. Consequently, connected miscellaneous petition is closed.
