Respondents Prayer: Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus, to direct the 1st respondent to dispose of the Appeal dated 05.01.2024 pending on the file of the 1st Respondent, on the light of the recommendation letter sent by the 2nd Respondent in Na.Ka.No.4/5110/2018 dated 19.12.2018, pertaining to the petitioner's land comprising in Rameswaram Revenue Village bearing Group Survey No.627/944 having an extent of 98 sq.mt (1058 1/16 sq.ft) within a stipulated period to be fixed by this Court. ORDER

The petitioner has filed this writ petition for a mandamus, to direct the first respondent to dispose of the appeal dated 05.01.2024 pending on the file of the first respondent, in the light of the recommendation letter sent by the second respondent in Na.Ka.No.4/5110/2018, dated 19.12.2018, pertaining to the petitioner's land comprising in Rameswaram Revenue Village bearing Group Survey No.627/944 having an extent of 98 sq.mt (1058 1/16 sq.ft).

2. The petitioner on whom the property in question had been settled on 23.04.1986 had applied for mutation of patta. However, the same has not been processed. The first respondent had directed the second respondent to conduct an enquiry and submit a report and the said report dated 19.12.2018 has also been submitted by the second respondent to the first respondent. However, till date no action has been taken. Therefore, the present writ petition.

3. Considering the case of the petitioner and the fact that requisite report dated 19.12.2018 has also been provided by the second respondent to the first respondent, a mandamus is issued to the first respondent to dispose of the petitioner's appeal dated 05.01.2024 within a period of six weeks from the date of receipt of a copy of this order.

4. With the above direction, this Writ Petition is allowed. No costs.
