PRAYER: This Petition is filed under Section 148 of CPC., to extend the time stipulated by this Court in C.M.P(MD)No.13618 of 2024 in C.M.A(MD)SR.No.40336 of 2024, dated 29.01.2025, to comply with the condition order.

ORDER

This petition has been filed to extend the time stipulated by this Court in C.M.P(MD)No.13618 of 2024 in C.M.A(MD)SR.No.40336 of 2024, dated 29.01.2025, to comply with the conditional order. 2.The learned counsel for the petitioner submitted that the main Civil Miscellaneous Appeal was filed to challenge the award passed in M.C.O.P.No.520 of 2020 on the file of the Motor Accident Claims Tribunal (Sub Court), Tirunelveli and filed the Petition in C.M.P(MD)No.13618 of 2024 to condone the delay of 2 days in filing the above Civil Miscellaneous Appeal. The said delay condone petition was came up for hearing on 29.01.2025 and this Court allowed the same on condition to pay Rs.500/- as costs to the High Court Legal Services Committee attached to this Bench 2/4

within a period of two weeks from the date of receipt of a copy of that order. Further, he submitted that the order was dispatched only on 28.02.2025. From that within 15 days, i.e., on 14.03.2025, the petitioner paid the cost of Rs.500/- and he also filed proof for the same.

3. The learned counsel for the third respondent has not raised any objection.

4. Considering the above facts and circumstances and also considering the fact that the cost has been paid within time from the date of receipt of a copy of that order, this petition for extension of time is unnecessary.

5. Hence, this petition is closed as unnecessary. Registry is directed to number the Civil Miscellaneous Appeal if it is otherwise in order and list the matter on 06.02.2026.
