O R D E R

The writ petitioner filed this Writ Petition seeking for issuance of a Writ of Mandamus, directing the second respondent to consider the petitioner's representation, dated 31.07.2024 more specifically to give permission and provide necessary police protection for conducting Annathanam in Mariamman Temple situated between PanniyanSivanathapuram, Usilampatti Taluk, Madurai District on 09.08.2024 scheduled between at 10.00 am to 01.00 pm.

The learned counsel appearing for the writ petitioner would submit that the petitioner has given a representation dated 31.07.2024 for conducting Annathanam on 09.08.2024 in Mariamman Temple situated between Panniyan-Sivanathapuram and Usilampatti Taluk Madurai District. But, the second respondent has not considered the said representation. Since no order was passed, the writ petitioner has come before this Court for the above said relief. He would further submit that he has already filed the copy of the photos taken in the last year and also the list for purchasing the grocery and vegetables for this year.

3. The learned Additional Public Prosecutor appearing for the State would submit that since two groups are planning to give Annathanam, it will create law and order problem. He would further submit that the petitioner may be permitted to conduct Annadanam faraway from the temple.

4. At this juncture, the learned counsel for the petitioner would submit that he is ready to conduct Annathanam at the place proposed by the Police authorities nearby the temple premises (500 meter distance from the temple).

5. Recording the same, the second respondent is directed to give permission for conducting Annathanam to the petitioner in the place to be selected by the second respondent (preferably at a distance of 500 meter from the temple premises) by imposing necessary conditions.

6. With the above directions, the Writ Petition is disposed of. No costs.
