PRAYER :- For Bail in Crime No.109 of 2021 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner, who was arrested and remanded to judicial custody on 23.09.2021 for the offence punishable under Section 25(1A) of Arms Act, 1959 in Crime No.109 of 2021 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that on 23.09.2021, when the respondent police made a routine patrol, he found that the petitioner illegally possessed sickle. Hence, the present case came to be registered.

3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case.

4.The learned Government Advocate (Crl.Side) appearing for the respondent police, on instructions, would submit that two previous cases registered under Section 302 IPC, are pending against the petitioner and the investigation is pending. He would further submit that the petitioner is a history sheeter.

5.Taking into consideration the facts and circumstances of the case, the fact that the petitioner has two previous cases that too, registered under Section 302 IPC and also the fact that the petitioner is a history sheeter, this Court is not inclined to grant bail to the petitioner.
