ORDER

This Writ Petition is disposed of at the time of admission with the consent of the learned counsel for the petitioner, learned Central Government Standing Counsel for the first respondent and learned Government Advocate (Crl.Side) for the second respondent.

2. The petitioner is the second accused (A2) in Crime No.249/2023 registered by the second respondent for the offences under Sections 147, 296(b) and 324 IPC.

3. The learned Government Advocate (Crl.Side) for the second respondent submits that the charge sheet has been filed before the learned Judicial Magistrate, Natham, Dindgul and the same will be taken note by the Court. 2/4

Since no case is pending as on date, barring filing of the charge sheet, there can be no impediment for processing the petitioner's passport application in terms of Section 6 of the Indian Passport Act, 1967. However, Considering the fact that the charge sheet has already been filed, which is to be taken on record, this Court directs the second respondent to expedite the proceedings for taking the charge sheet on file within a period of four (4) weeks from today.

5. The first respondent shall await for a period of four (4) weeks and in case, the charge sheet is not taken on file by the learned Judicial Magistrate, Natham within such time, the first respondent shall proceed to process the application and issue passport to the petitioner as expeditiously as possible preferably within a period of two (2) months from the said date.
