ORDER

This Writ Petition is disposed of at the time of admission with the consent of the learned counsel for the petitioner, learned Central Government Standing Counsel for the first respondent and learned Government Advocate (Crl.Side) for the second respondent.

2. It appears that the petitioner is an tenth accused (A10) in Crime No. 9/2025, for the offences under Sections 191(2), 191(3), 296(b), 126(2), 115(2), 118(1), 351(3) and 79 of Bharatiya Nyaya Sanhita, 2023 and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 1998.

3. The learned Government Advocate (Crl.Side) for the second respondent confirms that the case is under investigation and no charge sheet has been filed 2/4

before any Court, as on date.

4. Considering the same, there can be no impediment to direct the first respondent to issue passport to the petitioner. Hence, the first respondent is directed to issue passport to the petitioner within a period of six (6) weeks from the date of receipt of a copy of this order.

5. In case, the charge sheet is filed, the petitioner shall hand over the passport to concerned Court and thereafter, retrieve the same as and when the petitioner proposes to travel abroad. In case, there is any breach, the first respondent is at liberty to cancel the passport.

6. This Writ Petition is allowed, with the above observations. No costs. Index : Yes / No 11.07.2025 Internet : Yes / No apd 3/4
