ORDER

This petition has been filed seeking for a direction to the 2nd respondent to conclude the investigation by considering the petitioner's representation dated 06.12.2025.

The learned counsel appearing for the petitioner submitted that the proposed accused had allegedly induced the petitioner to permit to use the petitioner's credit cards citing financial constraints on the promise that the amounts so utilised would be repaid within a short period. However, after availing such credit facilities, the proposed accused failed to repay the amounts, thereby causing penal charges and financial hardship to the petitioner. In this regard, the petitioner had lodged a complaint with the respondent police. However, the same is not considered and hence, this petition came to be filed.

3. The learned Government Advocate appearing for the respondent police, on instructions, submitted that upon receipt of the complaint from the petitioner, CSR No.71 of 2025 was issued. However, owing to the noncooperation of both parties, the enquiry could not be proceeded with and was consequently closed.

4. In response, the learned counsel appearing for the petitioner submitted that the petitioner was not at all called for enquiry.

5. Heard the learned counsel on either sides and carefully perused the materials placed before this Court.

6. Considering the facts and circumstances of this case, the second respondent police is directed to reopen the petitioner's complaint in CSR No.71 of 2025, and conduct a discreet enquiry in this regard, after issuing summons to the petitioner and also other concerned parties, under Section 64 of the BNSS, and conclude the same, after affording an opportunity of hearing to them, within a period of four weeks from the date of receipt of a copy of this order.
