No.8680 of 2021 dt.28.10.2021 in Crl.A.(MD).No.436 of 2021. Prayer in CRL.A.(MD)No.436 of 2021:

To take this appeal on file, call for the records from the lower court, hear the counsel for the appellant/accused and allow the same by setting aside the conviction and sentence imposed on the appellant/accused passed in C.C.No.8 of 2011 by the II Additional Sessions Judge(CBIcases) Madurai, dated 27.09.2021. Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.AZAGARSAMI.AK., Advocate for the petitioner and of Mr.M.D.POORNACHARE, Special Publi Prosecutor on behalf of the Respondent, the court made the following order:- This petition has been filed to relax the condition imposed on the petitioner in Crl.M.P.(MD) No.8680 of 2021 in Crl.A.(MD) No.436 of 2021 on 28.10.2021.

2.The learned counsel for the petitioner submitted that the petitioner has been complying with the condition from 07.07.2021 and he prayed for relaxation of the said condition. He would further submit that the petitioner is aged about 71 and he is not in a position to travel Pollachi to the respondent police station for reporting.

CRL MP(MD) No.10648 of 2022 3.The learned counsel for the respondent would submit that the petitioner has been complying with the condition regularly and the condition may be relaxed to appear before the respondent police once in 6 months.

4.Taking into consideration of the submissions made by both the counsels, the condition imposed by this court in Crl.M.P.(MD) No.8680 of 2021 in Crl.A.(MD) No.436 of 2021 on 28.10.2021 is relaxed and considering the age condition of the petitioner, he shall appear before the learned Additional District Judge No.II, CBI Court, Coimbatore once in six months at about 10.30 am., until further orders.
