ORDER
The present Writ Petition has been filed seeking a direction to the third respondent to upload the corrected FMB sketch in terms of the proceedings of the second respondent dated 19.06.2025 and, thereafter, to survey and demarcate the petitioner's property.
2.The case of the petitioner is that an extent of 0.56.00 hectares in Survey No.112/1C1 belonged to his father, namely, Dhanushkodi. The petitioner's father passed away on 15.05.2023, leaving behind his wife, namely, Sinthamani (the petitioner's mother), two daughters, namely, Pitchammal and Dhanalakshmi, and 2/7
four sons, namely, Vijayaramalingam, Kasirajalingam, Solairajalingam and Anbulingam. Thereafter, the legal heirs executed a Partition Deed and a Release Deed dated 02.02.2024, registered as Document No.144 of 2024. Subsequently, patta was mutated in the names of the legal heirs.
3.While so, one Rajathi, claiming rights over the petitioner's family property, got the patta mutated illegally. The same was contested by the petitioner and his family members. Subsequently, the mutation was cancelled vide proceedings dated 19.06.2025 and the patta was restored in the petitioner's name. However, the corresponding correction has not been effected in the Field Measurement Book (FMB) records. Therefore, the petitioner seeks restoration of the same in the online records. Based on the above facts, the petitioner has also sought survey and demarcation of the property by submitting an online application. Since the said application has not been considered by the respondents, the present Writ Petition has been filed.

4.The petitioner apprehends that the said Rajathi is acting in collusion with the local Surveyor. Hence, the petitioner seeks survey and demarcation of the land with the assistance of the District Surveyor, namely, the fourth respondent. 5.Considering the facts and circumstances of the case, this Court directs the third respondent to conduct a survey and demarcate the property with the assistance of the fourth respondent/District Surveyor, after issuing notice to the petitioner, the other legal heirs, and the said Rajathi. If the Tahsildar requires police protection for conducting the survey, the jurisdictional police shall provide the necessary assistance.
6.In the event the petitioner seeks installation of boundary stones, the same shall be carried out at the petitioner's cost. 7.This Court further directs the official respondents to adhere to the following Standard Operating Procedure: 4/7
(a) The official respondents shall issue notice to the petitioner before commencing the survey proceedings at the site. The petitioner shall acknowledge receipt of such notice by affixing his signature.
(b) Upon completion of the survey, the petitioner shall again affix his signature acknowledging that the survey has been conducted and indicating whether he is satisfied with the same. (c) In the event the petitioner is not satisfied with the survey, he shall nevertheless affix his signature recording his dissatisfaction or protest and shall state the reasons therefor.
The aforesaid procedure shall be strictly followed by all concerned. The entire exercise shall be completed within a period of twelve (12) weeks from the date of receipt of a copy of this order. Based on the survey report the petitioner prayer to upload the FMB shall be considered by the respondents and the same shall be considered within a period of four weeks therefrom.
8.With the above directions, this Writ Petition stands disposed of. No costs.
