Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, to direct the 1st respondent to carry out the survey and

settlement operation in the TS.No.57, 56 part south and 58 west New Ward No.P.Block No.4, admeasuring to an extent of 4,760 square fast situated at Devadhanam Village, Sathiyamoorthy Nagar East, Tiruchirappalli 620 008, with a specific direction to localize the encroached portions in the said property with measurements with the assistance of the 2nd respondent.

ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the 1st respondent to carry out the survey and settlement operation in the TS.No.57, 56 part south and 58 west New Ward No.P.Block No.4, admeasuring to an extent of 4,760 square fast situated at Devadhanam Village, Sathiyamoorthy Nagar East, Tiruchirappalli 620 008, with a specific direction to localize the encroached portions in the said property with measurements with the assistance of the 2nd respondent.

2.The petitioner is seeking to survey his property situated TS.No.57, 56 part south and 58 west New Ward No.P.Block No.4, admeasuring to an extent of 4,760 square fast situated at Devadhanam Village, Sathiyamoorthy Nagar East, Tiruchirappalli 620 008, and also earmark the encroached portions. 3.Since the petitioner is seeking only to survey the land and earmark the encroachments, this Court is inclined to allow the same. However, the first respondent is strictly directed to issue notice to the petitioner as well as the encroachers / individual respondents. The 1st respondent shall issue notice and thereafter conduct an enquiry and pass an order. While removing the encroachments,

the first respondent is directed to seek police protection from the second respondent. The enquiry shall be completed within a period of three months from the date of receipt of a copy of this order.

3.With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
