ORDER

This petition has been filed seeking direction to the third respondents not to harass the petitioner and his family members. 2.The learned counsel for the petitioner submitted that the petitioner has been falsely implicated in Crime No.330 of 2018, which was also culminated in Spl.S.C.No.16 of 2019, which is pending before the PCR Court, Dindigul. Except the above said case, no other case is pending against the petitioner and he has also served as Panchayat Tank Operator in their village. 3.The learned Additional Public Prosecutor submitted that the petitioner was history sheeted in H.S.No.91 of 2019. Crl.O.P.(MD)No.16084 of 2021 for the purpose of serving notice under Section 107 Cr.P.C. proceedings search was made. Except that there is no harassment. But so far it has not been served on the petitioner. 4.If any summon is served upon the petitioner, it is the duty of him to face the proceedings or challenge the same. Without doing so, refusal of notice is not proper on the part of the petitioner. I find no merits in this case and this petition deserves to be dismissed.

5.Accordingly, this Criminal Original Petition stands dismissed.
