Prayer: Contempt Petition filed under Section 11 of the Contempt of Courts Act, 1971 to punish the contemnors/respondents for their willful disobedience of the order passed by the Honourable Court made in W.P(MD) No.11269 of 2020 dated 25.03.2024.

ORDER

(Order of the Court was made by the Hon'ble P. VELMURUGAN. J.) The petitioner filed W.P(MD)No.11269 of 2020 for a Mandamus directing the respondents to remove the unauthorized constructions put up by the respondents 4 to 6 in S.No.120/1, Managiri-Sukkanendal Village, Karaikudi Taluk, Sivagangai District. By order dated 25.03.2024, a Division Bench of this Court disposed of the said writ petition with a direction to the 3rd respondent herein to take necessary action for removal of unauthorized construction put up by the private respondents therein after providing opportunity to all the parties concerned and file a report before the High Level Monitoring Committee within a period of twelve weeks from the date of receipt of the order. Alleging disobedience of the said order, the writ petitioner has filed this contempt petition.

The learned standing counsel for the 3rd respondent would submit that the areas in which the unauthorized constructions are sought to be removed, are now attached to the limits of Karaikudi Corporation and the Commissioner of Karaikudi Corporation is the competent authority to remove the same. 3.

The Commissioner, Karaikudi Corporation is also present before this Court. He undertakes that the order of this Court will be implemented within a time frame.

Recording the abovesaid undertaking, this Contempt Petition is closed for the present. The Commissioner of Karaikudi Corporation is directed to implement the order of this Court within a period of four weeks from the date of receipt of a copy of this order, failing which, the Contempt Petition will be re-opened automatically without further reference.
