PRAYER :- BAIL. For Bail in Crime No.152 of 2023 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioner/sole Accused, apprehending arrest at the hands of the respondent Police for the alleged offence punishable under Sections 294(b), 307, 324 and 506(ii) 1/4
I.P.C r/w. Section 4 of TNPHW Act @ 294(b), 324, 302 and 506(ii) of IPC r/w. Section 4 of TNPHW Act, in Crime No.152 of 2023 on the file of the respondent Police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner had assaulted the defacto complainant's elder sister namely Muneeswari and her husband with aruval, thereby caused injuries to them, the said deceased Muneeswari taken to the Hospital and while under treatment, she died. Hence, the complaint.
3. The learned counsel for the petitioner submitted that the petitioner, the defacto complainant and the deceased are all relatives. The petitioner did not commit any such offences as alleged by the prosecution. At that time of occurrence, there is wordy quarrel between the petitioner and one Venkatachalapathy. Suddenly with an intention to threaten the petitioner, the said Venkatachalapathy took the Aruval and thrown it in the forehead of the petitioner and he took treatment in the Sivakasi Government Hospital.
4. The learned Additional Public Prosecutor would submit that the investigation has not been completed and is under way.
5. Considering the facts and circumstances of this case and considering that it is the preliminary stage of investigation, if the petitioner is released on bail, he may abscond or tamper the witness and it would hamper the investigation process, this 2/4
