Respondents Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the 1st Respondent to remove the Vinai Theertha Vinayagar temple situated on the north new street of Sattur Town, Virudhunagar District by encroaching the public road within the time stipulated by this Court.

ORDER

(Order of the Court was made by NOOTY.RAMAMOHANA RAO, J.) After generating considerable length of debate at the Bar, Shri.N.Tamilmani, learned counsel for the writ petitioner sought for permission to withdraw the writ petition and instead approach the civil Court, so that an appropriate adjudication can be indulged in by the civil Court.

2.Conceding to the request of the learned counsel, the Writ petition stands dismissed as withdrawn, preserving liberty to the writ petitioner to approach the competent Court of civil jurisdiction for securing redressel of the grievance ventilated in this Writ petition. No costs.
