When the matter is taken up for hearing, the learned counsel appearing for the petitioner would submit that on the wrong representation of the learned Additional Public Prosecutor, that summon already served on the petitioner, the above Criminal Original Petition was dismissed by this Court on 22.10.2021. Actually no summon was served on the petitioner for the subject matter.

3. If there is any mis-representation, the petitioner is at liberty to file recall petition.
