ORDER : The Court made the following order :- The petitioner/Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Section 328 IPC and Section 8(c0, 20(b)(ii)(A) of NDPS Act, in Crime No.174 of 2023, on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that on 04.07.2023, the accused persons found in possession of 25 grams of ganja. Hence, the complaint. 1/3
3.The learned counsel for the petitioner submitted that he is innocent and not committed any offence, as alleged by the prosecution. He was implicated in this case, based on the confession of co-accused. The co-accused has already been enlarged on bail. Hence, prays to release him on anticipatory bail. 4.The learned Government Advocate (Crl.Side) submitted that the petitioner is having eight previous cases to his credit. In which, most of the cases were registered for robbery, assault and theft. Only the petitioner had supplied ganja to A1. Hence, prayed to dismiss the petition. 5.Heard the learned counsel appearing on either side and perused the materials placed before this Court.
6.Considering the nature of the case and considering the bad antecedents of the petitioner, he seems to be a habitual offender. Hence, this Court is not inclined to grant anticipatory bail to him.
