RESPONDENT/ COMPLAINANT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to Modify the condition imposed upon the petitioner in Crl O.P(MD) No. 12799 of 2021 order dated 07.09.2021 on the file of this Hon'ble court.

Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.G.KALIDOSS, Advocate for the petitioner and of Mr.RMS.SETHURAMAN, Additional Public Prosecutor on behalf of the Respondent, the court made the following order:- This petitioner has filed the above petition to modify the condition imposed by this Court in Crl.O.P.(MD)No.12799 of 2021, dated 07.09.2021, by directing him to deposit Rs.35,000/-(Rupees Thirty Five Thousand only) to the credit of the Chief Minister's Public Relief Fund.

2. Heard the learned Counsel for the petitioner and the learned Additional Public Prosecutor appearing for the State and also perused the materials placed on record.

3. It is evident from the order passed in Crl.O.P.(MD)No.12799 of 2021 that this Court has observed as follows: " 5. CRL MP(MD) No.8660 of 2021 Relief Fund, this Court is inclined to grant anticipatory bail to the petitioner."

and thereafter, this Court passed an order directing him to pay a sum of Rs.35,000/-(Rupees Thirty Five Thousand only) to the credit of the Chief Minister's Public Relief Fund.

4. Since this Court has passed the said order only on the basis of the willingness of the petitioner, this Court does not find any merit in the contention now raised by the petitioner. Hence, this Criminal Miscellaneous Petition is liable to be dismissed. Accordingly, the same is dismissed.
